Lawyers for the homeless couple who started the deadly warehouse fire in Worcester two years ago that killed six firefighters will argue before the state's highest court next month that grand jury proceedings were tainted by bogus and misleading evidence.
The Supreme Judicial Court has agreed to hear oral arguments in the case of Julie Barnes and Thomas Levesque Jan. 10 and will rule whether the pair should be prosecuted for six counts of manslaughter.
"The case presents novel issues," said Louis Aloise, Barnes' attorney. "Issues that have never really been decided in Massachusetts, especially whether or not there is in fact a legal duty to report a fire. and, if there's a breach of that duty, is it criminal or simply negligence? …
